End User Agreement

This End User Agreement governs the use of Estimator Pro, a business application operated by Kirk Builders. By using Estimator Pro, including its connection to QuickBooks Online, you agree to the terms below.
1. Purpose of Estimator Pro
Estimator Pro is designed to assist with construction estimating, customer management, project-related information, and related business operations.
The current QuickBooks Online integration is intended to work with:
• QuickBooks Customers for client synchronization
• QuickBooks Estimates for estimate creation and synchronization
Additional QuickBooks functionality may be added in the future only when intentionally enabled by Kirk Builders.
2. Authorization to Connect to QuickBooks
Estimator Pro connects to QuickBooks Online only after an authorized QuickBooks user grants permission through Intuit’s authorization process.
You are responsible for ensuring that you have authority to connect the applicable QuickBooks company to Estimator Pro.
You may revoke the QuickBooks connection at any time through Intuit or through a disconnect function provided by Estimator Pro.
3. Your Data
You remain responsible for the accuracy of customer, estimate, and other business information entered into or synchronized through Estimator Pro.
You should review information before relying on it for contracts, purchasing, accounting, tax reporting, or other business decisions.
4. QuickBooks Online
QuickBooks Online is a third-party service provided by Intuit Inc. Kirk Builders does not control QuickBooks Online and is not responsible for interruptions, changes, errors, or availability of Intuit services.
Use of QuickBooks Online remains subject to Intuit’s own terms, policies, and agreements.
5. Acceptable Use
Estimator Pro may not be used to:
• Access a QuickBooks company without authorization
• Circumvent security or access controls
• Interfere with the operation of Estimator Pro, QuickBooks Online, or related systems
• Use data in violation of applicable law
6. Availability and Changes
Estimator Pro may be updated, changed, improved, or temporarily unavailable from time to time.
Features may be modified as the application develops, including features related to QuickBooks synchronization.
7. No Accounting, Tax, or Legal Advice
Estimator Pro is a business-management and estimating tool. It does not provide accounting, tax, financial, or legal advice.
Users are responsible for consulting qualified professionals when appropriate.
8. Disclaimer
Estimator Pro is provided on an “as available” basis. While reasonable efforts are made to maintain reliable operation and accurate data handling, no software system can be guaranteed to operate without interruption or error.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Kirk Builders will not be liable for indirect, incidental, special, or consequential damages arising from the use of Estimator Pro or from interruptions or changes to third-party services such as QuickBooks Online.
10. Termination
Access to Estimator Pro or its QuickBooks integration may be discontinued if the application is misused, authorization is revoked, or continued operation is no longer possible.
Disconnecting QuickBooks does not automatically delete business records already lawfully stored in Estimator Pro.
11. Privacy
Information handled through Estimator Pro is subject to the Estimator Pro Privacy Policy available on the Kirk Builders website.
12. Changes to This Agreement
This agreement may be updated from time to time. The current version will be posted on this page with an updated revision date.
13. Governing Law
This agreement is governed by the laws of the State of Minnesota, to the extent permitted by applicable law.
